Joseph & Roberts, LLC (“J&R”) built the DashCams Protect® app and this website (collectively, “the J&R software” or “Service”) as a Free app. This Service is provided by J&R at no cost and is intended for use as is.

This page is used to inform visitors regarding this policies with the collection, use, and disclosure of Personal Information if anyone decided to use this Service.

If you choose to use this Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that J&R collect is used for providing and improving the Service. J&R will use its best efforts to not use or share your information with anyone except as described in this Privacy Policy.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at dashcams.com unless otherwise defined in this Privacy Policy.

Information Collection and Use

For a better experience, while using our Service, J&R may require you to provide it with certain personally identifiable information, including but not limited to your name, address, phone number, email address, dashcam serial number, date of purchase, and name of dealership where purchased. The information that J&R requests may be retained and used by J&R for its legitimate business purposes.

The app does use third party services that may collect information used to identify you.

Google Play Services

Log Data

J&R want to inform you that whenever you use this Service, in a case of an error in the app J&R collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing this Service, the time and date of your use of the Service, and other statistics.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device’s internal memory.

This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

Service Providers

J&R may employ third-party companies and individuals due to the following reasons:

To facilitate our Service;

To provide the Service on our behalf;

To perform Service-related services; or

To assist J&R in analyzing how its Service is used.

J&R want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

Information we may collect

When we provide services, we may collect, store and use the following information about you. If you do not provide relevant information, you may not be able to enjoy some of the services we provide, or you may not be able to achieve the intended effects of the relevant services.

1.1 Personal information

We collect, use, store and disclose personal information to provide you with services by creating accounts, identifying users, responding to inquiries and emails, etc. J&R may provide you with the management and related services with the user’s permission, and provide you with better services by sending notifications, surveys, preferential information and other promotional materials.

1.2 Collected for service purpose

You can use the J&R software without a user account. If you want to use more functions, you can register this application and provide relevant personal information. The information collected by J&R is limited to the information necessary for you to agree to use the basic service.

1.3 User provided

1.3.1 If you need to use more dashcam functions by utilizing the DashCams Protect® app, you may need to complete your personal information.

1.3.2 The information you provide, J&R will use its best efforts to maximize the reasonable commercial obligations to keep confidential. J&R may provide you with information notifications, event pushes, version upgrades and other services.

1.4 J&R may implement a tool used to send information and other content between users. If you send information or other content to another user using such a J&R tool, the J&R server may save this information/content for you and send this information/content to that user.

1.5 Other ways you provide information

We may collect your personal information in other ways (for example: email, information download, purchase of products or services, feedback). If you fill in your personal information on other open platforms, other users may learn your information.

1.6 Information you share online

All the information you share online recorded on your dashcam (including but not limited to photos, videos, etc.) may be open to all viewers by default. You must be responsible for all actions under your registered account, including any content you send or post. J&R cannot and will not be liable for any losses caused by the user’s own actions. In order to avoid legal risks, users are not allowed to use the J&R software or any video bearing “DashCams Protect®” branding or the url “dashcams.com” to create, upload, copy, or send the following content:

Oppose the basic principles established by the Constitution;

Endangering national security, leaking state secrets, subverting state power, and undermining national unity;

Damage to national honor and interests;

Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;

Undermine national religious policies and promote cults and feudal superstitions;

Spread rumors, disrupt social order, and undermine social stability;

Spread obscenity, pornography, gambling, violence, murder, terror, or abet crime;

Insult or slander others, and infringe the lawful rights and interests of others;

Information that contains other content prohibited by laws and administrative regulations.

1.7 Your other information

In order to facilitate your use of the J&R software, our server may collect information about your mobile communication device, such as model, device ID, Internet protocol address, time and location of your visit, routing data packets, sender of information and receiving data (But not the information itself), and other similar characteristic records. We may use cookies and navigation data like Uniform Resource Locator (URL) to collect the time and date of your visit, search and view information, etc.

1.8 location information

Information about your location collected when you turn on the device positioning function and use our location-based related services.

When you use our service through a mobile device with a positioning function, your geographic location information may be collected through GPS in order to obtain the wifi name of the relevant device.

2. Use of personal information

2.1 Unless this privacy agreement as updated from time to time specifies otherwise, your personal information will not be used for other purposes.

2.2 Anonymous aggregate statistical data is not personal user information as defined by J&R. J&R may store and use such information for a variety of purposes, including but not limited to analysis and usage pattern reports. J&R reserves the right to allow third parties to use and disclose anonymous aggregate statistical data for any purpose or unilaterally.

2.3 All the information you share in any community provided by or in connection with J&R (including but not limited to photos, videos, etc.) may be disclosed to all viewers by default, and may be copied, forwarded, altered or used for other illegal purposes by other organizations or individuals. This may  damage the legitimate interests of you or others, and you must be fully aware of the existence of such risks. You expressly agree to bear all risks and consequences of sharing information by yourself, and J&R does not need to bear any responsibility.

3. Disclosure of personal information

3.1 Except for the limited disclosure stated in this privacy agreement, J&R will use its best efforts to properly store your personal information and not disclose the list of customers.

3.2 You hereby authorize that, in the following circumstances, we may disclose your personal information to a third party without your consent：

3.2.1 It is necessary to identify, contact or file a lawsuit against actions that may cause damage to our rights or property, users or any other person (including the rights and property of any other person);

3.2.2 The need for legal investigation;

3.2.3 It is necessary for subpoenas or other warrants issued by courts or law enforcement agencies and served on J&R by law

3.3 For the purpose of sharing interesting videos or warning viewers to pay attention to traffic safety, J&R may forward the information shared by users to the community (including but not limited to photos, videos, etc.) to third-party platforms. The user continued use of the J&R software constitutes their agreement to J&R forwarding to third-party platforms.

4. Assistance

You should assist J&R to protect the security of your personal information. For example, don’t reveal your personal password.

5. Collection and use of personal information of young people

5.1 We recommend that minors under the age of 18 use the J&R software with the permission and guidance of their legal guardian.

5.2 J&R will not intentionally use the personal information of minors, nor will it intentionally disclose identifiable information of minors to any third party except where required by law. The guardian has the right to refuse J&R to further collect the personal information of the ward, or request J&R to delete the ward Personal information.

6. Amendments to this privacy agreement

6.1 This privacy agreement allows adjustments, which will be made at this website. By continuing to use any of the J&R software, you agree that you are on notice of and agree to the latest version of this privacy agreement.

6.2 If you do not want J&R to change the use of your personal information, you must notify J&R before you expect to stop using our account. Your continued use of J&R software will be deemed to be that you know and agree to be bound by such changes in the notice.

7. Permission description

7.1 The purpose of obtaining the ACCESS_FINE_LOCATION and ACCESS_COARSE_LOCATION permissions is to obtain the geographic location when the WiFi name is obtained.

7.2 The purpose of obtaining CAMERA permission is to take pictures and record videos.

7.3 The purpose of obtaining INTERNET permission is to access the device server.

7.4 The purpose of obtaining the WRITE_EXTERNAL_STORAGE permission is to store the video or picture files passed by the dash cam.

7.5 The purpose of obtaining the READ_EXTERNAL_STORAGE permission is to read the pictures or videos in the local album when posting.

7.6 The purpose of obtaining the ACCESS_WIFI_STATE permission is to check whether the user’s mobile phone is connected to the Internet.

Security

J&R values your trust in providing J&R your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and J&R cannot guarantee its absolute security.

Therefore, J&R strongly advises you to review the Privacy Policy of these websites. J&R has no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Children’s Privacy

These Services do not address anyone under the age of 13. J&R does not knowingly collect personally identifiable information from children under 13 years of age. In the case J&R discovers that a child under 13 has provided it with personal information, J&R immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided J&R with personal information, please contact J&R so that J&R will be able to do necessary actions.

Please read these SMS Terms & Conditions (the “SMS Terms”) carefully. By enrolling or otherwise agreeing to receive text messages from or on behalf of Joseph & Roberts, LLC (“J&R”) or by otherwise providing your phone number to J&R, you agree to these SMS Terms, as well as J&R’s Privacy Policy, which is incorporated herein by reference and can be viewed at the link provided here, or at dashcams.com.

Text message communications. We may use text messaging to communicate with you about your service. Normal messaging rates apply and the frequency of messages may vary. Mobile carriers are not liable for delayed or undelivered messages.

Opting into Text Messages.  By opting into any J&R text program, you expressly consent to receive recurring marketing text messages that may be sent using an automatic telephone dialing system, by or on behalf of J&R, at the cell phone number you provide us. By voluntarily providing your cell phone number to J&R, you consent to receive transactional, operational, or informational text messages at that phone number, including but not limited to order confirmations; and shipping and delivery notifications. Please note we may not be able to deliver messages to all mobile carriers. Consent to receive texts is not a condition of purchasing any goods or services, and you understand and agree that all text messages may be sent using automated technology. 

Opt-out of text message communications. You may opt-out of text messaging at any time by replying to any message with STOP, or by contacting us at support@dashcams.com. This will end the communications from that particular phone number. You may continue to receive service-related and other non-marketing text messages from other phone numbers managed by J&R, and you may opt out of those in a similar fashion.

Eligibility and Change in Phone Number.  By opting into J&R’s text messaging program(s) or by otherwise providing your cell phone number to J&R, you warrant that you are 18 years of age or older. You further warrant that you are the current subscriber or authorized user of the phone number you have provided. You agree that you will not initiate messages to the mobile phone of any other person or entity without authorization. If you change, forfeit, or deactivate the phone number you have provided to J&R, you agree to notify J&R immediately.

Changes to This Privacy Policy

J&R may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. J&R will notify you of any changes by posting the new Privacy Policy on this page.
